Une coalition d’avocats et d’ONG ont déposé mardi six nouvelles plaintes contre le Maroc devant le Comité contre la torture (CAT) des Nations unies à Genève dans lesquelles elle exige notamment la libération de tous les prisonniers sahraouis condamnés sur la base d’aveux obtenus sous la torture.
“Maîtres Francesca Doria, Brigitte Jeannot, Ingrid Metton, France Weyl (pour l’Association internationale des juristes démocrates) et la FIDH (Fédération internationale de droits humains), avec le soutien de la Ligue pour la Protection des prisonniers politiques sahraouis dans les prisons marocaines, déposent six nouvelles plaintes devant le CAT des Nations unies à Genève pour six défenseurs sahraouis des droits humains membres du groupe de prisonniers politiques de Gdeim Izik”, souligne cette coalition dans un communiqué conjoint.
“Les six requérants, Mohamed El Bachir Boutanguiza, Abdellahi Lakhfaouni, Sidi Ahmed Lemjiyed, Ahmed Sbai, Abdullahi Toubali et El Houssein Zaoui demandent au Comité d’enquêter sur les sévices subis suite à leurs interpellations mais aussi durant leur longue détention”, ajoute la même source, relevant que “12 ans après le démantèlement du campement de Gdeim Izik, la quête de justice pour les faits de torture sur les prisonniers sahraouis continue”.
Les requérants, “détenus dans des conditions inhumaines et dégradantes depuis 12 ans, ont été condamnés définitivement par la Cour d’appel de Rabat en 2017 sur la base d’aveux obtenus sous la torture à des peines allant de 20 ans de réclusion criminelle à la perpétuité”.
“Ces conditions de détention sont dénoncées au Comité, les requérants subissant au quotidien des actes de torture et des traitements inhumains et dégradants : violences physiques et psychologiques, placement à l’isolement, impossibilité de rencontrer leur famille, refus d’accès aux soins et refus du droit au transfert près de leurs familles au Sahara occidental”, précisent les signataires.
Condamné à plusieurs reprises par le Comité contre la torture, poursuit la coalition, “le Maroc refuse systématiquement de se conformer aux décisions du Comité”, indiquant que “malgré les menaces et les représailles à leur encontre et à l’encontre de leurs familles et malgré les intimidations de leurs soutiens, les requérants, confiants dans les institutions internationales, continuent de saisir les Nations unies de leur situation inhumaine”.
Soulignant, par ailleurs, que les décisions du CAT doivent être respectées par le Maroc, les signataires mettent l’accent sur le fait que “l’adhésion aux Conventions internationales de protection des droits humains ne peut pas être une simple opération de communication du Maroc pour blanchir son image à l’international, et doit être suivie d’effets”.
“Tous les prisonniers condamnés sur la base d’aveux obtenus sous la torture et détenus arbitrairement doivent être libérés et le Maroc doit assurer leur droit à réparation”, ont-ils insisté.
Pour rappel, le CAT a déjà condamné le Maroc plusieurs fois pour des faits de torture sur des prisonniers politiques sahraouis.
En novembre 2016, le comité onusien avait condamné le royaume chérifien pour avoir torturé Naâma Asfari, porte-parole du campement de Gdeim Izik.
Sa femme, la défenseure des droits humains, Claude Mangin et lui-même sont encore à ce jour, victimes de représailles.
En 2022, le CAT a de nouveau condamné le Maroc pour des actes de torture commis sur deux autres membres du même groupe de Gdeim Izik. Et en juin 2022, quatre plaintes de requérants sahraouis – trois membres du groupe dit de Gdeim Izik et un membre du groupe dit d’El Oual – ont été déposées auprès du CAT.
