ALGÉRIE/ POLITIQUE : Les prérogatives de Bensalah, selon la constitution
Les prérogatives du Chef de l’Etat, dont le poste sera assuré par M. Abdelkader Bensalah, pour une période de 90 jours au maximum, sont définies par la Constitution, notamment dans son article 104.
Comme le stipule la Constitution, le Président du Conseil de la Nation assume la charge de Chef de l’Etat pour une durée de 90 jours au maximum, au cours de laquelle des élections présidentielles sont organisées, sachant que le Chef de l’Etat, ainsi désigné, ne peut pas être candidat à la Présidence de la République.
Au cours de cette période, le Chef de l’Etat dispose de prérogatives très réduites par rapport à un président élu. A cet effet, il ne peut être fait application des dispositions prévues aux alinéas 7 et 8 de l’article 91 et aux articles 93, 142, 147, 154, 155, 208, 210 et 211 de la Constitution.
Selon les dispositions de ces articles, le Chef de l’Etat ne dispose pas de prérogatives du Président de la République, notamment en ce qui concerne la nomination de membres de gouvernement, le droit de grâce, la remise ou la commutation de peine, ou saisir, sur toute question d’importance nationale, le peuple par voie de référendum.
Il ne dispose pas également des prérogatives relatives à la dissolution de l’Assemblée populaire nationale (APN), la tenue d’élections législatives anticipées ou la révision constitutionnelle.
En outre, les dispositions des articles 105, 107, 108, 109 et 111 de la Constitution ne peuvent être mises en œuvre qu’avec l’approbation du Parlement siégeant en chambres réunies, le Conseil constitutionnel et le Haut Conseil de Sécurité préalablement consultés.
Ces dispositions concernent la déclaration de l’état d’urgence, l’état de siège, l’état d’exception, la déclaration de guerre en cas d’agression effective ou imminente, ainsi que la mobilisation générale.
Le Parlement, réuni en ses deux Chambres (Conseil de la Nation et l’APN), mardi à Alger, a pris acte de la déclaration de vacance définitive du poste de président de la République, à la suite de la démission de M. Abdelaziz Bouteflika.
M.Bensalah assume de fait le poste de Chef de l’Etat pour une durée de 90 jours au maximum, conformément aux dispositions de l’article 102 de la Constitution.
