Les députés de l’Assemblée populaire nationale (APN) ont adopté, samedi, les deux projets de loi régissant la profession d’huissier de justice et celui relatif à la protection et à la préservation des terres relevant du domaine de l’Etat.
Le vote a eu lieu lors d’une séance plénière présidée par, Brahim Boughali, président de l’APN, en présence du ministre de la Justice, Garde des sceaux, Abderrachid Tabi et la ministre des Relations avec le Parlement, Basma Azouar.
“L’adoption de ces deux projets s’inscrit dans le cadre de la consécration des réformes en cours dans le secteur de la Justice en vue d’adapter les textes à l’actualité et de lutter contre les phénomènes étrangers à notre société”, a souligné M. Tabi après l’adoption.
L’adoption du projet de loi relatif à la protection et à la préservation des terres relevant du domaine de l’Etat fait preuve de sa fermeté et de son intolérance envers le pillage des bien de l’Etat, a-t-il estimé.
En vertu de cette loi, “les autorités compétentes doivent prendre les mesures d’anticipation face à toute sorte d’infraction”, a souligné M. Tabi, relevant “la mise en place des dispositions audacieuses contraignant chaque responsable à accomplir convenablement sa mission et assumer sa responsabilité en cas de manquement”.
Concernant le projet de loi modifiant et complétant la loi n 06-03 portant organisation de la profession de huissier de justice, M. Tabi a souligné que “le projet s’inscrit dans le cadre de la consécration des réformes en cours dans le secteur de la Justice, outre la reconsidération des textes juridiques régissant certaines professions des auxiliaires de justice”.
Une partie du projet de loi a été consacrée à l’assistance de l’huissier de justice dans la lutte contre le blanchiment d’argent et l’atteinte aux deniers publics, selon le ministre, par “l’obligation de l’huissier de justice à signaler, à l’organisme compétent, toute opération suspecte relative aux fonds obtenus illégalement ou qui semblent être destinés au blanchiment, ou pour financer le terrorisme”.
S’exprimant à l’occasion, le rapporteur de la commission des affaires juridiques, administratives et des libertés à l’APN, Houcine Nekakaa a rappelé la proposition de 38 amendements à la loi relative à la préservation des terres relevant de l’Etat, dont trois (3) acceptés et deux autres articles proposés par la commission pour mettre fin au pillage des terres de l’Etat.
Pour le projet de loi portant organisation de la profession d’huissier de justice, 31 amendements ont été proposé dont quatre (4) acceptés.
