Les députés de l’Assemblée populaire nationale (APN) ont adopté mardi le projet de loi fixant l’organisation, la composition et les attributions de la Haute autorité de transparence, de prévention et de lutte contre la corruption.
La séance de vote s’est déroulée en plénière présidée par Brahim Boughali, président de l’APN en présence du ministre de la Justice, garde des Sceaux, Abderrachid Tabi.
Les dispositions de ce texte s’appuient sur plusieurs conventions et traités internationaux ratifiés par l’Algérie, telles la Convention de l’Union africaine sur la prévention et la lutte contre la corruption de 2003, ainsi que la Convention des Nations unies contre la corruption et d’autres conventions similaires.
Le projet de loi prévoit 40 articles et plusieurs principes, dont la non-interférence entre les pouvoirs de la Haute autorité et des autres autorités chargées de la prévention et de la lutte contre la corruption, notamment le pouvoir judiciaire et la Cour des comptes.
Le texte détermine en outre les attributions de la Haute autorité, notamment dans le domaine de la consécration des principes de transparence et de probité dans la gestion des affaires publiques.
Selon le projet de loi, “toute personne physique ou morale peut saisir la Haute autorité de faits de corruption (informations, données ou preuves)” et “pour être recevables, les plaintes ou signalements doivent être adressé(e)s par écrit, être signé(e)s et contenir des éléments sur les faits de corruption et des éléments suffisants sur l’identité de l’auteur du signalement”.
L’autorité peut également, de sa propre initiative ou après sa saisine concernant un manquement aux conditions de probité, prendre plusieurs mesures : adresser des avertissements au concerné et notifier le procureur général compétent en cas de non-déclaration du patrimoine ou de fausse déclaration.
Cette autorité œuvrera à la promotion et au renforcement du rôle de la société civile dans la lutte contre la corruption par la mise en place d’un réseau favorisant la transparence dans l’organisation des activités caritatives, religieuses, culturelles et sportives des établissements publics et privés.
A noter que la Haute autorité “établira un rapport annuel sur ses activités qu’elle soumettra au Président de la République et informera l’opinion publique de sa teneur, en consécration de la culture de transparence”.
