La chambre pénale de la Cour de Boumerdès a prononcé, mercredi, “la nullité des procédures de poursuite judiciaire” contre l’ancien directeur général de la Sûreté nationale, Abdelghani Hamel et son fils Chafik dans l’affaire de détournement de foncier agricole et trafic d’influence.
Les anciens walis de Tipaza Kadi Abdelkader et Moussa Ghelaï ont vu leur peine réduite à trois ans de prison ferme pour chacun d’eux. L’ancien wali de la même wilaya, Mustapha Layadi a bénéficié des procédures d’extinction de l’action publique pour prescription.
Les autres coaccusés dans cette affaire ayant bénéficié de la nullité des procédures de poursuite sont: l’ancien chef de Sûreté de Tipaza, Salim Djai Djai, l’ancien ministre des Fiances Hadji Baba Ali, l’ancien directeur des domaines de Tipaza, Ali Bouamrirane, l’ancien directeur de l’industrie et des mines de Tipaza, Hadou Abderrezak, l’ancien conservateur foncier de Koléa, Mohamed Bouamama, l’investisseur privé Zerad Abdelhakim et l’ancien directeur général du Domaine national, Djamel Kheznadji.
Le Procureur général près la Cour de Boumerdès avait requis le durcissement de la peine pour tous les accusés poursuivis dans cette affaire.
Il a requis à l’endroit de l’accusé Djamel Kheznadji, acquitté en première instance, une peine de cinq (05) ans de prison ferme.
Les accusés dans cette affaire sont poursuivis pour plusieurs chefs d’accusation, notamment “détournement de foncier agricole”, “dilapidation de deniers publics”, “abus de fonction”, “trafic d’influence”, et “bénéfice du pouvoir et de l’influence des agents de l’Etat à l’effet d’augmenter les prix et modifier la qualité des matériaux, des services et des délais de livraison”.
Le tribunal de première instance de Boumerdes avait rendu le 4 juin 2020 son verdict dans cette affaire, en condamnant l’ancien DGSN, Abdelghani Hamel et l’ancien wali de Tipasa Moussa Ghelaï à douze ans (12 ans) de prison ferme.
Il a également confirmé la peine de 10 ans de prison ferme contre chacun des ex-walis de Tipasa, Kadi Abdelkader et Layadi Mustapha, ainsi que la peine de trois (3) ans de prison ferme contre Chafik Hamel (fils de l’ancien DGSN) et Salim Djai Djai, ex-chef de la sûreté de wilaya de Tipasa.
La même juridiction a condamné, dans la même affaire, à 4 ans de prison avec sursis l’ancien ministre des Finances, Hadji Baba Ammi, et à 5 ans de prison ferme l’ancien directeur des domaines de Tipasa, Ali Bouamrane.
Une peine de deux (2) ans de prison ferme a été prononcée contre l’ancien directeur de l’Industrie et des mines de Tipasa, Haddou Abderrezak, et l’ancien Conservateur foncier de Koléa, Mohamed Bouamama.
Le même tribunal a condamné l’investisseur privé Zerad Abdelhakim à une année de prison ferme et prononcé l’acquittement de l’ancien directeur général du Domaine national, Kheznadji Djamel.
