ALGÉRIE/ POLITIQUE : Le Syndicat National des Magistrats défend l’indépendance de la profession et répond à Gaid Salah
« On ne peut pas parler de justice indépendante et protégée avec les lois actuelles »
Dans un communiqué rendu public ce samedi 11 mai, les magistrats ont exprimé catégoriquement leur «refus» d’être un «simple appareil qui ne bouge que sous des ordres ou des convocations». Ils rejettent également des accusations venant des «milieux officiels et non officiels» qui doutent de l’indépendance de la justice.
Les magistrats insistent sur leur attachement à leur «droit constitutionnel en tant qu’autorité indépendante qui exerce ses fonctions conformément à la légalité et l’équité».
Cette sortie médiatique inédite du SNM, constitue clairement une réponse à peine voilée au chef de l’armée, Ahmed Gaid Salah, qui ne cesse de réitérer ses appels à la justice d’accélérer les poursuites contre certains hommes d’affaires et anciens responsables et que l’armée allait l’accompagner dans cette mission.
Une déclaration qui semble avoir été mal prise par le syndicat des magistrats pour qui aucune autorité fut-elle l’armée -qui détient le pouvoir réel désormais- ne doit intervenir dans le traitement des dossiers de justice.
« La garantie et la protection de la justice ne peuvent venir d’aucune autre partie étrangère au pouvoir judiciaire, mais se concrétisent à travers un certain nombre de procédures qui consacrent l’indépendance totale de la justice notamment l’amendement des lois et la révision des structures et organisent le travail et les carrières des magistrats», lit-on dans le communiqué du SNM.
En plus de cette prise de distance avec l’institution militaire, le syndicat a invité tout le monde à faire confiance aux magistrats dans la mesure où ils agissent «sans contrainte ni pressions» et qu’ils sont à équidistance entre les différentes parties de la société».
« L’appel pour une Algérie nouvelle implique un appel pour l’indépendance de la justice. Une justice qui doit être débarrassée de toutes les embûches matérielles et humaines. C’est ce que nous voulons atteindre en vue de contribuer d’une manière efficace à faire sortir le pays de la crise et l’amener vers des rivages sûrs, avec le peuple souverain dans le cadre des institutions constitutionnelles qui expriment sa volonté libre », est-il ajouté dans le communiqué.
Le SNM a élu, le 27 avril 2019, Issaad Mebrouk, nouveau président, en remplacement de Djamel Aidouni, après la fin de son mandat. Le SNM compte plus de 4500 adhérents. Issaad Mabrouk, juge près la Cour de justice de Béjaia, figue parmi les premiers magistrats à avoir rejoint le mouvement populaire.
