ALGÉRIE/ POLITIQUE : Abdallah Djaballah critique Bensalah, « président illégitime »
Le président du parti El Adala, Abdallah Djaballah, critique la prolongation du mandat « provisoire » d’Abdelkader Bensalah à la tête de l’Etat.
« Le chef d’Etat illégitime s’est appuyé sur une fetwa du Conseil constitutionnel datée du 2 juin 2019 sans prendre en considération sa situation de président illégitime. Le peuple l’accepte-t-il ou le refuse-t-il ? », s’interroge Djabellah.
« Cette décision est nulle et non avenue. Le chef d’Etat actuel n’a pas de légitimité. Il est refusé par le peuple qui, dans les marches, lui demande de quitter le pouvoir et d’abandonner la responsabilité. Le devoir constitutionnel et moral lui impose d’accepter cette demande et de quitter le pouvoir », ajoute-t-il dans une analyse publiée sur la page Facebook du parti.
Abdallah Djaballah rappelle que Bensalah a pris le pouvoir en application de l’article 102 de la Constitution après la démission d’Abdelaziz Bouteflika, le 2 avril dernier.
« Nous avons dit que cet article était inapplicable pour la situation que vit le pays. L’appliquer équivaut à une agression contre la souveraineté du peuple consacrée dans les articles 7, 8 et 12 de la Constitution et une manière d’ignorer les revendications populaires », souligne-t-il.
« Rester au pouvoir est une trahison et un complot contre le peuple »
Abdallah Djaballah rappelle l’échec des consultations politiques auxquelles a appelé le chef d’Etat provisoire le 22 avril et l’annulation de l’élection présidentielle du 4 juillet 2019.
« Pourquoi persiste-t-il alors à rester au pouvoir ? Est-il de l’intérêt du peuple et de la Patrie de persister dans l’erreur et de reproduire l’échec ? La fetwa du Conseil constitutionnel est politique et n’a pas de légitimité constitutionnelle. Le Conseil constitutionnel n’a pas indiqué la base sur laquelle il s’est appuyé pour rendre cette fetwa mais celui qui lit bien la Constitution découvre que le fondement est l’article 103. Cet article est également inapplicable (…) L’article 103 s’applique lorsque l’un des candidats est dans l’impossibilité de poursuivre la compétition pour cause de décès ou d’empêchement légal entre deux tours dans une situation de stabilité. Sommes-nous dans cette situation actuellement ? », s’interroge-t-il.
Pour Abdallah Djaballah, le chef de l’Etat actuel n’est pas reconnu et la situation du pays n’est pas stable. « Le peuple est sorti dans la rue et dans les places exigeant qu’ils partent tous, décidé à reconquérir sa souveraineté et à retracer un avenir à son pays, loin de toute tutelle. Il est dans la situation d’une Révolution pacifique sans commune mesure dans l’Histoire de l’Algérie. Les élections sous l’autorité de ceux qui sont au pouvoir sont refusées, aucun candidat n’a pu se présenter. Comment alors mettre en application l’article 103 ? Il n’y a aucune ressemblance entre les deux situations et donc la référence à ce texte est infondée. La fetwa du Conseil constitutionnel est nulle et ne peux pas être un fondement pour se maintenir au pouvoir. Rester au pouvoir est une trahison et un complot contre le peuple. Il ne reste au chef de l’Etat qu’à quitter son poste et à l’institution militaire à l’aider à partir et à concrétiser les revendications populaires relatives à la prise de pouvoir par des personnalités civiles, respectées par le peuple, capables de préparer un bon retour au processus électoral », propose le président d’El Adala.
