ALGÉRIE/POLITIQUE : Corruption : le sénateur de Tipaza, Malik Boudjouher, condamné en appel à 7 ans de prison ferme
La chambre pénale près la Cour de Tipasa a confirmé aujourd’hui mardi le jugement de première instance prononcé, le 5 mai dernier, contre le membre du Conseil de la Nation, Malik Boudjouher, condamné à 7 ans de prison ferme dans une affaire de corruption.
Ce jugement a été prononcé après la comparution, mardi dernier, du sénateur Boudjouher dans une audience en appel, durant laquelle le parquet avait requis une peine de 8 ans de prison ferme à son encontre, alors que la chambre de première instance l’a condamné à 7 ans de prison ferme, avec interdiction, pour une durée de 5 ans, d’exercer de hautes fonctions ou de se porter candidat à un poste politique, assortie d’une amende d’un million de dinars.
Il a été poursuivi, en août dernier, pour «obtention de privilèges indus», «abus de pouvoir» et «abus de fonction», avant la programmation de son affaire en jugement en avril passé.
Le tribunal de Tipasa a, également, acquitté deux prévenus, accusés de «privilèges indus» et ordonné la restitution de leurs véhicules saisis le 14 août dernier par la police judiciaire, lors de leur arrestation avec le principal accusé.
Ces derniers avaient en leur possession 2 millions de DA versés par la victime, en contrepartie de la facilitation de procédures de régularisation du dossier de réalisation illicite d’un projet touristique dans la région de Chenoua.
Lors de cette audience, la victime a maintenu ses dires en accusant le sénateur Boudjouher de «constitution d’une bande d’escrocs et raquetteurs en usant d’un masse media local et d’une page facebook».
Le sénateur s’est dit, quant à lui, «victime d’un conflit politique et de complots d’ex-responsables locaux».
La chambre pénale avait rejeté, mardi dernier, les arguments de la défense de l’accusé principal, concernant sa «mise en liberté», afin de procéder à la levée de l’immunité parlementaire, dont il jouit, avant qu’il ne fasse l’objet de procédures de poursuites judiciaires, comme a plaidé par maitre Mokrane Ait Larbi.
L’arrestation de Boudjouher s’appuie sur les articles 111 du code pénal et 128 de la Constitution stipulant qu’en cas de flagrant délit ou de crime flagrant, il peut être procédé à l’arrestation d’un député ou d’un membre du Conseil de la Nation.
